Marcos M. Córdoba (Buenos Aires (Argentina), November 19, 1953), is an argentine jurist and professor.

Doctor of Law from the University of Buenos Aires (1994). [1] His dissertation, "La posesión hereditaria" was widely awarded. Among others, with the "Professor Eduardo Prayones Award", for the Best Civil Law Research, the "University of Buenos Aires Award" in 2001 and the "Faculty Award" (Resolution C.D. N° 11838/98 of October 31, 1998) considered the "Best Outstanding Thesis of Law" of "exceptional merit".[2] [3]

He is credited with being the founder of the "School of Legal Solidarity",[4] [5] [6] [7] [8] [9] which postulates in its doctrine that solidarity between individuals is a general principle of law, an assertion not recognized by the jurisprudence of his country until the disclosure of its work. [10] His ideas inspired the implementation of civil norms that have granted effective judicial protection in alimony payments[11] and the incorporation, in the new Argentine Civil and Commercial Code, of specific protections for the disabled. [12] These ideas granted him the acknowledgments in countries of diverse political orientations such as Italy and Cuba.[13] [14] Particularly, his approach towards heirs with disabilities is a novelty provided by Córdoba and granted in article 2448 of the Civil and Commercial Code of Argentina. It should be noted that the original text provided by Córdoba to the commission that drafted the Code, included hereditary protection to every heir who sacrifices himself or herself to aid a person, including the spouse. Legislators eliminated this last provision in the Civil and Commercial Code.[15]

His latest research creates the conviction that the law, to provide harmony among individuals, must be based on the principle of equity, as the quality of being fair and impartial, rather than on the state of being equal. These ideas gave rise to debate in the international legal community. Distinctly, his speech addressed in the historic Berlin Parliament at the Tempelhof / Schöneberg City Hall in 2013 hosted by the Mayor of Berlin, Angelika Schöttler, highlighted his contribution in this regard. The Argentine Embassy in Germany and the Austrian magazine LSVD recorded the impact. [16] [17] [18]

Honors and awards

He has been appointed Knight of the Grand Cross of the Order of Merit of the Italian Republic, at the proposal of the Presidency of the Council of Ministers of the Italian Republic. December 27, 2019.[19]

  • Award "Senator Domingo F. Sarmiento". In 2017 the Senate of the Argentine Republic granted him its highest award for his entrepreneurial work aimed at improving the quality of life of his peers, institutions, and their communities.[20] [21] [22]
