Mark Anthony Niemczyk (born 1946) is an American criminal who gained national notoriety when he was convicted in 2013 of felony theft by deception for his 9/11 truck scam, which occurred from mid 2010 to mid 2012 when he and accomplice Thomas Scalgione were arrested in New Jersey. Niemczyk, who used stolen valor in the scam by falsely claiming to be a retired Navy SEAL, was first exposed by Retired Navy SEAL Don Shipley on his YouTube channel, becoming a “Phony Navy Seal of the Week” in 2011.[1]

The pair sold T-shirts and collected donations at 9/11 events using truck painted with Twin Towers Baukus pleaded guilty to the charges and was sentenced to 38 years in prison with the possibility of parole.
