Ben Pennings is an Australian environmental activist, best known for his role as a leading organiser in the movement against the development of the Adani Group's Carmichael coal mine in Central Queensland. His activism led to a high-profile civil lawsuit filed against him by Adani in the Supreme Court of Queensland.

Early Life and Career

Pennings holds a Bachelor of Science in Environmental Health and has worked in the environmental sector for over 20 years. His professional experience includes working as an Environmental Health Officer for the Brisbane City Council (1998–2005) and subsequently as an Environmental Officer and Manager for various other organisations until 2017[1]. He now runs a large mental health practice in Brisbane.

Activism

Pennings was the national spokesperson and a key organizer for the activist group Galilee Blockade[2], which coordinated direct action and campaigning efforts aimed at disrupting and preventing the construction and operation of the Carmichael mine.

The campaign specifically targeted contractors, insurers, and financial institutions involved with the Adani project. Pennings' supporters framed his actions as peaceful protest aimed at protecting the environment and climate.

In 2020, he was awarded the Bob Brown Foundation Environmentalist of the Year[3].

Adani v. Pennings

In June 2020[4], Adani Group initiated legal proceedings against Pennings in the Supreme Court of Queensland, seeking $17 million in damages.

Allegations

Adani's claims against Pennings and Galilee Blockade centred on allegations of:

  • Conspiracy to injure Adani’s coal operations in Australia.
  • Inducing Breach of Contract and Intimidation relating to Adani’s contractors.
  • Breach of Confidence relating to confidential information.

Adani claimed that the actions of Pennings and the Galilee Blockade had significantly impacted their operations, including:

  • Forcing the downgrade of the Carmichael mine from 30 million tonnes per year to 10 million tonnes per year in late 2017.
  • Causing a resultant increase of at least 15% to the capital cost per tonne of coal due to the downscaling.
  • Leading to a 400% rise in insurance premiums and a 500% rise in security costs.
  • Causing all Tier One contractors to abandon the project, forcing Adani to rely on less experienced Tier Two and Three contractors, which allegedly increased contractual costs by at least 15%.

Legal Proceedings and Developments

During the initial stages of the legal action, Adani’s legal representatives reportedly utilised private investigators to follow Pennings' family members, including his wife and children. Adani also attempted, on two occasions, to obtain secret orders to raid the Pennings family home, both of which were unsuccessful.

Due to the ongoing litigation, Pennings stepped down from his role as national spokesperson for Galilee Blockade after a Supreme Court injunction was obtained against him in September 2020.

In a significant development in September 2023, after three years of litigation, Adani formally abandoned its key allegation[5] that Pennings had received or used their 'confidential information.' As of late 2023, Pennings' legal team had argued in a three-day hearing that the remaining parts of the case should be 'struck out' or that the entire case should be declared an 'abuse of process'; the judgment for this application is pending.

December 2024 Judgment

On 6 December 2024[6], Justice Susan Brown of the Supreme Court of Queensland delivered a key judgment on Pennings' application to strike out the case.

  • Claims Struck Out: Justice Brown struck out substantial parts of Adani's claim, with the judge reportedly describing some of the company's pleadings as "confused and embarrassing." Specifically, the court struck out allegations that "demands and threats" by Pennings had caused companies, including Greyhound and Downer, to withdraw from contracts connected with the mine, citing a lack of causal nexus or consistency with evidence.
  • Case Allowed to Continue: Justice Brown did not agree that the entire case constituted an "abuse of process" and, despite striking out the deficient claims, allowed Adani (trading as Bravus Mining & Resources) the "liberty to replead" the sections of its case that were disallowed. Adani was given until February 2025 to file a new statement of claim.
  • Injunction and Costs: The judge rejected Pennings' application to have the injunction against him lifted. However, a costs order made against Pennings in a preliminary hearing in 2021 was ordered to be stayed until the conclusion of the proceedings.

Pennings stated he was "extraordinarily relieved" by the judgment, noting that the "vast majority of the allegations against me have been struck out," despite the case remaining afoot.

Personal Life

Pennings is described by his supporters as an "Aussie dad" being pursued by a large corporation, often using the social media hashtag #DadvsAdani to garner support for his legal defence fund.
